Ex-ante Policy Impact Assessment in the Czech Republic
Legal backgroundThe Government of the Czech Republic adopted an Action Plan of Reducing Administrative Burden on Businesses in April 2005, as well as the Government resolution 421/2005, 'Methodology of Measurement of Administrative Burden', based on the Dutch Standard Cost Model. There is a 'two stage' legislative drafting process in the country, and separate concepts for minor and major RIAs which differ in the scope of detail of the analysis. Minor RIA is mostly qualitative analysis with possible estimate of financial impacts, whereas a major RIA is a detailed cost-benefit analysis with respect to a single or a few solution options. Institutional backgroundThe Department of Regulatory Reform and Public Administration Quality was set up in the Ministry of Interior in November 2006. It is responsible for coordinating regulatory reform across the state administration, simplification of the regulatory environment and the preparation of strategies and concepts in the public administration area. The work of the Department is conducted by its three special units: Impact Assessment Unit, Quality of Regulation Unit and Strategies and Concepts Unit. Regulatory Impact Assessment in the Czech Republic is based on the framework of the European analytical methods providing for systematic evaluation of negative and positive impacts of the drafts or existing regulations, taking into account economic, social and environmental impacts at once. Moreover, impacts on particular economic or social groups are taken into account. The Regulatory Impact Assessment results in the final report which accompanies each legislative draft. Background data and studies elaborated during the process of Regulatory Impact Assessment are used as a basis for the policy decision-making process in which either the proposed draft or amendment to the existing regulation are approved or not. In order to ensure efficient Regulatory Impact Assessment, the Unit co-operates with all central state administration authorities which prepare legislative drafts from the beginning of the regulation-making process and provides them with the methodological assistance in assessing impacts of proposed pieces of legislation. The main goals are to achieve the most cost-effective legislation, to provide for a transparency in the legislative process and to have a higher quality of regulation. RIA is furthermore to be used for ex-post assessment of existing regulations. Carrying out the impact assessment of a legislative proposal is the responsibility of the body elaborating the proposal. The control of the quality and methodological assistance, however, is the role of a specialized unit, the Department of Regulatory Reform and Public Administration in the Ministry of Interior. It is recommended, however not compulsory for the ministries to set up specialized RIA units in their structure.
