Ex-ante Policy Impact Assessment in Cyprus
Legal background When Cyprus became an independent republic in 1960, the Constitution provided for continuation of English common law therefore the country has had the advantage of a legal system and institutional structure which had developed over a long period of time. There are no specific requirements by law to undertake regulatory impact assessment, since the operation of the policy formulation and legislation drafting process is a matter of custom rather than something which is regulated by rules of law or procedure, as is the case in the civil law world. According to the Constitution however each bill submitted to Parliament must be accompanied by a report called "Objects and Reasons" signed by the Attorney General of the Republic. The National Reform Programme of the RepublicofCypruslaid down priorities for the implementation of a regulatory management reform. In that case, priority was attached within that programme to the development of a policy on impact assessment and the reduction of the regulatory and administrative burden. Institutional background All draft bills before reaching the Council of Ministers go through the Office of the Attorney General which has a staff of 80 lawyers and support people. The Ministry of Finance is mainly responsible for Better Regulation policy in the country. The review of the ministry over the laws lays in the obligation that the draft laws submitted to the Council of Ministers must be accompanied by a written opinion of the Ministry of Finance, except in cases where there is no connection with budgetary issues. Responsibility for the planning of strategic and developmental policy activity is vested in the Cyprus Planning Bureau. Planning of other policy initiatives rests with individual ministries. The Planning Bureau was established following a decision of the Council of Ministers and placed under the Minister of Finance. In cooperation with the Ministry of Finance, it is responsible for the 5-year strategic plans laying out all the development projects and coordinates the planning procedures for the country. Since civil society is well developed in the country, the process of consultation at different stages of the regulation making process is conducted even if they are not required by any law and there are no agreed procedures to carry them out. There is clearly visible political support regarding the implementation of the Better Regulation agenda of the European Commission. Relevant areas of IA
Related activities Courses on legislative drafting have been organized for responsible officials. The first One-Stop-Shop for citizens was opened in December 2005 so as to deliver better access to certain categories of government information and a range of services It brings together the following services: identity documents, car registration, health and social benefits. It is an additional facility provided for the convenience of the public and services continue to be offered in the specific offices of each ministry. The One-Stop-Shop is staffed with seconded staff from the various relevant ministries. It is intended as a showpiece of the government’s policy to make administration more accessible to the public. A Working Party to investigate the means by which impact assessment may be incorporated into the policy-making process was appointed. A number of surveys have been undertaken on the initiative of either the Public Administration or Personnel Department of the Ministry of Finance, or the relevant department or service, for the reduction of red tape.
