Ex-ante Policy Impact Assessment in Turkey

Legal background

The adoption and use of the RIA system could enforce Turkey’s efforts towards EU accession, so the motivation is high for the country. There have already been several attempts to introduce the methodology in the legal system.

The 2002 OECD review of regulatory reforms in the country was taken into account when designing the regulatory reform efforts.

In order to reduce red tape and administrative burden, in November 2006 “one-stop” offices were established in the governorates and district governorates of the country to lessen the administrative burden on citizens requesting certain public services. Also administrative burdens on businesses and direct investments have been substantially lifted. These efforts have been coordinated by the Prime Minister’s Office.

However, the Law on Basic Principles of Public Administration that was adopted by the parliament in 2004 and included provisions for RIA, was vetoed by the president for reasons unrelated to RIA; this law included an article making regulatory impact assessment compulsory both for draft legislation and for proposals creating new public departments.

The Turkish government adopted a regulation in February 2006 which introduces regulatory impact assessment into the Turkish legal system. This decree establishes RIA with a year to prepare the system through real life pilot regulatory impact assessments. The Prime Minister’s Office dropped the draft law in July 2006, and in September the office established an inter-ministerial Task Force (Ministries of Health, Agriculture and Environment), with international consultants, to drive the pilot RIA. The Prime Minister’s Office acted as RIA unit in the process. Such an introduction of RIA methodology to the Turkish legal system allows the country to learn the system by doing it. This is particularly important, since the institutional capacity for conducting regulatory impact assessments needs to be reinforced. The results of the pilot RIA were presented at a meeting with stakeholders and at a public seminar as well. This was followed by presenting the RIA to the Cabinet in April 2007.

Regulatory Impact Analysis is a legal necessity in Turkey from 2007 onwards.

Institutional background

A Better Regulation Group was formed in 2005, involving a number of experts at the Prime Minister’s Office.  Since then, the office has been active in formulating the RIA system in Turkey. It acted as RIA unit during the first major pilot RIA

Related activities

Training seminars and technical assistance from SIGMA have been organized for interdisciplinary participants on how to better develop and coordinate RIA policies.
E-governance applications have been introduced, and their user-friendliness was improved.
During the pilot Impact Assessments, several study tours have been organized to see the RIA system working in the United Kingdom.

Existing guidelines

Regulatory Impact Assessment guidelines were adopted in 2007 to enhance the quality of regulations.
